PontoonStuff "Fun on the Water" Photo Contest Disclaimer

By participating in the "Fun on the Water" Photo Contest ("Contest") organized by PontoonStuff ("Company"), you agree to the following terms and conditions:

1. Eligibility

   This Contest is open to individuals aged 18 and older. Employees of PontoonStuff, its affiliates, subsidiaries, advertising, and promotion agencies, and their immediate family members are not eligible to participate.

2. Photo Usage Rights

   By submitting your photo(s) ("Entry") to the Contest, you agree that PontoonStuff has a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, distribute, publicly display, and create derivative works of the Entry for marketing and promotional purposes in all forms of media, including but not limited to social media, websites, print materials, and other marketing platforms.

3. Selection of Winners

   Winners will be selected based on creativity, originality, and relevance to the theme "Fun on the Water" by a panel of judges chosen by PontoonStuff. All decisions are final. Winners will be notified via email or direct message.

4. Prize

   Winners will receive a gift card to PontoonStuff valued at [prize amount]. Prizes are non-transferable and may not be substituted for cash.

5. Model and Property Releases

   By submitting an Entry, you affirm that all individuals who appear in the photo have given you permission to be photographed and have granted you the rights to submit their image(s) in this Contest. If an Entry is selected as a winning photo, you agree to provide a signed model release form and/or property release form as applicable.

6. Originality and Ownership

   By submitting an Entry, you represent and warrant that (a) you are the sole and exclusive owner of the Entry, or you have all rights, licenses, consents, and releases necessary to grant PontoonStuff the rights in and to the Entry as set forth herein; and (b) the Entry does not infringe any third-party rights, including but not limited to copyright, trademark, privacy, publicity, or any other intellectual property rights.

7. Limitation of Liability

   By participating, you agree to release, discharge, indemnify, and hold harmless PontoonStuff, its affiliates, employees, and agents from any claims, damages, liabilities, or expenses arising from (i) your participation in the Contest, (ii) your Entry, and (iii) your acceptance, use, or misuse of any prize. PontoonStuff is not responsible for technical failures or any other error or malfunction.

8. Social Media Platform Disclaimer

   This Contest is in no way sponsored, endorsed, administered by, or associated with [Platform Name, e.g., Facebook, Instagram]. By entering, you release [Platform Name] from any liability related to this Contest.

9. Privacy

   Any personal information collected from participants will be used solely for the purpose of administering the Contest and in accordance with PontoonStuff’s privacy policy.

10. Modification and Termination

    PontoonStuff reserves the right to cancel, suspend, or modify the Contest in its sole discretion if any fraud, technical issues, or other factors beyond PontoonStuff’s control impair the integrity of the Contest, as determined by PontoonStuff.
